This Data Protection Notice (“Notice”) setsout the basis which Bostex Technologies International Pte Ltd(“ Bostex”) maycollect, use, disclose or otherwise process personal data in accordance withthe Personal Data Protection Act (“PDPA”). This notice applies to personal datain our possession or under our control, including:

  • personal data in the possession oforganisations which we have engaged to collect, use, disclose or process personaldata for our purposes.

  • personal data from our websites (regardlessof where you visit them from).

It is important that you read this privacynotice together with any other privacy policy we may provide on specificoccasions when we are collecting or processing personal data about you so thatyou are fully aware of how and why Bostex is using your data.
Where we share your data with our related parties,customer, supplier/service provider, we do so on a need to know basis and on termswhereby such data is to be kept secure and confidential.

PERSONALDATA

2.      Personal data” means data/any information,whether true or not, about an individual who can be identified:

(a)  from that data; or
(b)  from that dataand other information to which we have or are likely to have access.

 

3.       Dependingon the nature of your interaction with us, Bostex may collect, use, storeand transfer various types of personal data about you including:

  • Identity data (whichmay include your title, name, passport/driving licence/national identificationcard information, gender, nationality, date of birth, country of birth, photographs,other audio-visual information, race or ethnicity, religious or philosophicalbeliefs, information relating to criminal convictions, political opinions, politicallyexposed person (PEP) status and personal data available in the public domain);

  • Contact data (whichmay include postal address, email address, telephone numbers and other contactdetails);

  • Professional/employment data (whichmay include educational background, professional qualifications, professionalcertifications, employment history, training history, payroll/human resourcesinformations, work-related health issues, details of directorship/other officeswhich you may hold, any additional information provided to us by you as anemployee/prior to being engaged as an employee );

  • Financial data (whichmay include sources of wealth, details of your assets, shareholdings andbeneficial interest in assets, bank account details, credit history);

  • Family relationships data (whichmay include your marital status, the identity of your spouse/partner and anychildren you may have);

  • Third party relationships data (whichmay include your employer, advisors, service providers (including bankers andinvestment advisers) and entities with which you are associated);

  • Technical data (whichmay include your internet protocol (IP) address, how you use our website,browser type and version, time zone setting and location, and other technologyavailable from the devices you use to access our websites);

  •       Marketingand communications data (which may include your preferences inreceiving marketing from us and our third party providers and yourcommunication preferences).

     

    COLLECTION,USE AND DISCLOSURE OF PERSONAL DATA

    4.       Wegenerally do not collect your personal data unless :

(a)       it is provided tous voluntarily by you directly or via a third party who has been dulyauthorised by you to disclose your personal data to us (your “authorisedrepresentative”) after:

i)          you (or yourauthorised representative) have been notified of the purposes for which thedata is collected, and

ii)         you (or yourauthorised representative) have provided written consent to the collection andusage of your personal data for those purposes, or

(b)       collection and useof personal data without consent is permitted or required by the PDPA or otherlaws.

We shall seek yourconsent before collecting any additional personal data and before using yourpersonal data for a purpose which has not been notified to you (except wherepermitted or authorised by law).

 

5.      Wemay collect and use your personal data for any or all of the following purposes.Bosex will use your personal data to:

  • perform a contract that we are about to enterinto or have entered into with you;

  • facilitating our compliance with any laws,customs and regulations which may be applicable to us(including for theprevention and detection of fraud, money laundering and other crimes);

  • respond to requests, enquiries or complaintsreceived from you or someone connected to you;

  • establish, exercise or defend legalproceedings and/or Bostex’s legal rights;

  • compile statistics in relation to the use ofour websites;

  • send you marketing material;

  • be used for other legitimate business purposes;

  • enable us to display relevant targetedadvertisements to you about products and services that may be of interest;

  • review and process any application you makein relation to recruitment;

  • perform obligations under or in connectionwith your contract of employment/agreement with us or in connection with theprovision of our goods or services to our customers;

  • perform all administrative, operational processes andhuman resources related matters within our organisation or with third partiesfor work related purposes.

    Bostexdoes not generally rely on consent as a legal basis for processing yourpersonal data other than in relation to sending marketing communications to youvia email. You have the right to withdraw consent to marketing at any time bycontacting us. 

    6.      Wemay disclose your personal data:

    (a)where such disclosure is required for performing obligations in the course ofor in connection with our provision of the goods and services requested by you;or

    (b)to third party service providers, agents and other organisations we haveengaged to perform any of the functions with reference to the above mentionedpurposes.

     

    ACCURACY OF PERSONAL DATA

    7.      Wegenerally rely on personal data provided by you (or your authorisedrepresentative). In order to ensure that your personal data is current,complete and accurate, please update us if there are changes to your personaldata by informing our Data Protection Officer in writing or via email at thecontact details provided below.

     

    CHANGE OF PURPOSE

    8.      Wewill only use your personal data for the purposes for which we collected it,unless we reasonably consider that we need to use it for another reason andthat reason is compatible with the original purpose.  If we need to useyour personal data for an unrelated purpose, we will notify you and we willexplain the legal basis which allows us to do so.

    Pleasenote that we may process your personal data without your knowledge or consent,in compliance with the above purposes, where this is required or permitted bylaw.

     

    SHARINGPERSONAL DATA

    9.      Bostexmay share your personal data with the parties set out below for the purposeslisted above.

    Internal. Othercompanies in the Bostex Group.

    External. Thefollowing third parties:  

  • Service providers acting as processors whoprovide IT and system administration services;

  • Professional advisers acting as processors orjoint controllers including lawyers, bankers, investment advisers, auditors,brokers, insurers and accountants who provide, legal, banking, advisory, audit,insurance and accounting services;

  • Tax authorities, regulators and otherauthorities acting as processors or joint controllers who require reporting orprocessing or information for tax, regulatory or legal compliance.

  • Fraud prevention agencies acting as jointcontrollers.

  • Courts or other competent judicial orgovernmental body to comply with legal obligations such as combating moneylaundering and terrorist financing where such parties would be acting as jointcontrollers.

  • Organisations and individuals if you haveapplied for a role with Bostex, in order for us to obtain references,confirmation of details, work related application for courses/pass/approval etcdocuments required including pass for on site support at customer site.

     

    DATASECURITY

    10.    Tosafeguard your personal data, Bostex has introduced security measures toprotect your personal data from being accidentally lost, used or accessed in anunauthorised way, altered or disclosed.  In addition, we limit access toyour personal data to those who have a business need to know.  They willonly process your personal data on our instructions and they are subject to aduty of confidentiality. 

    Bostexhas put in place procedures to deal with any suspected personal data breach andwe will notify you and any applicable regulator of a breach where we arelegally required to do so.

    Wegenerally do not transfer your personal data to countries outside of Singapore.However, if we do so, we will obtain your consent for the transfer to be madeand will take steps to ensure that your personal data continues to receive astandard of protection that is at least comparable to that provided under the PDPA.

     

    DATARETENTION

    11.    Bostexwill only retain your personal data for as long as necessary to fulfil thepurposes we collected it for, including for the purposes of satisfying anylegal, regulatory, tax, accounting, or reporting requirements. 

    To determinethe appropriate retention period for personal data, we consider the amount,nature and sensitivity of the personal data, the potential risk of harm fromunauthorised use or disclosure of your personal data, the purposes for which weprocess your personal data and whether we can achieve those purposes throughother means, and the applicable legal requirements.

     

    YOURLEGAL RIGHTS

    12.   Undercertain circumstances, you have rights under data protection laws in relationto your personal data we process, you have the right to:

  • request access your personal data;

  • request correction of your personal data;

  • request restriction of the use of yourpersonal data;

  • request your personal data is erased; and

  • object to processing of your personal data.

    Wherewe have relied on consent or our legitimate interests to process your personaldata, you have the right to withdraw consent at any time. If you choose to doso, we may not be able to provide our services to you.

    WITHDRAWING YOUR CONSENT

    13.    Theconsent that you provide for the collection, use and disclosure of yourpersonal data will remain valid until such time it is being withdrawn by you inwriting. You may withdraw consent and request us to stop collecting, usingand/or disclosing your personal data for any or all of the purposes listedabove by submitting your request in writing or via email to our Data ProtectionOfficer at the contact details provided below.

    Uponreceipt of your written request to withdraw your consent, we may requirereasonable time (depending on the complexity of the request and its impact onour relationship with you) for your request to be processed and for us tonotify you of the consequences of us acceding to the same, including any legalconsequences which may affect your rights and liabilities to us. In general, weshall seek to process your request within thirty (30) business days ofreceiving it.

    Whilstwe respect your decision to withdraw your consent, please note that dependingon the nature and scope of your request, we may not be in a position tocontinue providing our goods or services to you and we shall, in suchcircumstances, notify you before completing the processing of your request.Should you decide to cancel your withdrawal of consent, please inform us inwriting in the manner described in clause 7 above.

    Pleasenote that withdrawing consent does not affect our right to continue to collect,use and disclose personal data where such collection, use and disclose withoutconsent is permitted or required under applicable laws.

     

    ACCESS TO AND CORRECTION OF PERSONAL DATA

    14.    If you wish to make (a) an access request for access to a copy ofthe personal data which we hold about you or information about the ways inwhich we use or disclose your personal data, or (b) a correction request tocorrect or update any of your personal data which we hold about you, you maysubmit your request in writing or via email to our Data Protection Officer at thecontact details provided below.

    Pleasenote that a reasonable fee may be charged for an access request. If so, we willinform you of the fee before processing your request.

    Wewill respond to your request as soon as reasonably possible. In general, our responsewill be within thirty (30) business days. Should we not be able to respond toyour request within thirty (30) days after receiving your request, we willinform you in writing within thirty (30) days of the time by which we will beable to respond to your request. If we are unable to provide you with anypersonal data or to make a correction requested by you, we shall generallyinform you of the reasons why we are unable to do so (except where we are notrequired to do so under the PDPA).

     

SPECIFIC INFORMATION

Website

15.    Everytime an user visits our website, technical information of the user is collectedfor the contributions to the subject of information security, information (alsoreferred to as server log files) is automatically collected by us or thewebspace provider.

Among other information this includes: website name, file, date, datavolume, web browser and web browser version, operating system, the domain nameof your Internet provider, the referrer URL (the page from which you accessedour offer) and the IP address.

Without this information, it would not be technically possible todeliver and display the website content. In this respect, collecting data isabsolutely necessary. Furthermore, we use this information for statisticalpurposes. They help us to optimise our services and technology. We also reservethe right to check the log files in case of suspected illegal use of ourservices.

Bostex Technologies International Pte Ltd does not track its customersover time and across third party websites to provide targeted advertising andtherefore does not respond to Do Not Track (DNT) signals.

 

Cookies

16.    Ourwebsite uses cookies. Cookies are text files that are stored on your computerby the server. They contain information about the browser, the IP address, theoperating system and the Internet connection. We will not pass on this data tothird parties or link it to personal data without your consent.

Cookies have two main purposes. They help us make it easier for you tonavigate through our services and they also enable the website to be displayedcorrectly. They are not used to spread viruses or to open programs.

 

Integrating third-party services and content

17.    Ourrange includes content, services and services from other suppliers. Forexample, this might be videos, graphics or images from other websites. In orderfor this data to be retrieved and displayed in the user’s browser, transmittingthe IP address is absolutely necessary. The providers (hereinafter referred toas “third-party providers”) detect the IP address of the respective user.

 

Contact form

18.    Ifyou contact us via the online contact form or by email, we will save theinformation you provide, your IP address and the time it was sent. This allowsus to answer your request and ask possible follow-up questions. 

 

Google Analytics

19.    Ourwebsite or email service provider may use the standard analysis tool “GoogleAnalytics” of Google Inc. (short: “Google”). Google Analytics uses cookies(text files that are stored on the computer). The generated information aboutthe use of the website is transmitted to an American server of Google andstored for further processing.

The data collected by Google Analytics is evaluated to generate reportson user activity and to optimize your user experience. In order to contradictthe storage of the cookies, please make the appropriate setting in yourbrowser. Please note that you can only use other areas of this website to alimited extent.

 

CHANGES TO THE PRIVACY NOTICE AND YOUR DUTY TO INFORM US OF CHANGES

We may make changes to this privacy noticefrom time to time without notice, in which case the date of the notice will beup dated.

It is important that the personal data wehold about you is accurate and current.  Please keep us informed if your personal data changes during your relationshipwith us.

As part of our efforts to ensure that weproperly manage, protect and process your personal data, we will be reviewingour policies, procedures and processes from time to time.
